Terms of Service

1. Acceptance of these Terms
These Terms of Service (the “Terms”) govern your use of MichiColle (the “Service”), operated by J Web Creation Co., Ltd. (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
The Service records drives of your Tesla vehicle via the Tesla Fleet API and presents them as a personal driving journal with routes and statistics. The Service is currently under development; features may change, and availability is not guaranteed during the development and beta period.
3. Eligibility and accounts
You must be able to enter a binding agreement and must own, or be authorized by the owner to connect, the Tesla account and vehicles you link to the Service. You are responsible for keeping your account credentials secure and for all activity under your account.
4. Tesla account connection
- You may connect only your own Tesla account and access only your own vehicle data. Connecting another person's account without authorization is prohibited.
- Your use of Tesla's services remains subject to Tesla's own terms and policies; these Terms do not modify them.
- You can revoke the Service's access at any time from your Tesla account's third-party app settings.
5. Safety — no use while driving
You must not view, touch, or otherwise operate the Service while driving. The Service records drives automatically in the background and requires no interaction during a drive. Always comply with traffic laws and use the Service only when the vehicle is parked or you are not the driver. The Service is a journal for looking back on drives; it is not designed for, and must not be used for, timing, racing, or competing on speed.
6. Acceptable use
You agree not to:
- use the Service in violation of any law or regulation;
- access or attempt to access data of any person or vehicle other than your own;
- use the Service to organize or promote speed competitions, street racing, or dangerous driving;
- interfere with, disrupt, probe, or attempt to bypass the security of the Service;
- reverse engineer, scrape, or resell the Service except as permitted by law.
7. Fees and subscriptions
The Service is currently provided free of charge during development. A paid subscription may be introduced in the future; pricing and conditions will be announced in advance, and no charge will apply without your explicit agreement. The following applies once paid subscriptions begin (and is not yet in effect):
- You may cancel a subscription at any time; cancellation stops renewal at the end of the current billing period, during which the Service remains available.
- Except as required by applicable law, fees already paid are not refunded for partial periods.
- Payment processing will be handled by a third-party payment provider (such as Stripe); its terms apply to the payment transaction.
8. Privacy
Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms.
9. Intellectual property
The Service, including its software, design and content (excluding your data), is owned by us or our licensors. Your drive records remain yours; you grant us the limited license needed to store and process them solely to provide the Service.
10. Relationship to Tesla, Inc.
MichiColle is an independent product. It is not affiliated with, endorsed by, or sponsored by Tesla, Inc. “Tesla” and related marks are trademarks of Tesla, Inc., used here only to describe compatibility. Tesla, Inc. bears no responsibility for the Service.
11. Disclaimers
The Service is provided “as is” and “as available”. Recorded data depends on the Tesla Fleet API and on vehicle connectivity, and may be delayed, incomplete, lost, or unavailable. Road-section completion determinations may be inaccurate, and the map and elevation data used by the Service may contain errors. We do not warrant that records or determinations are complete or error-free, and the Service must not be relied on for legal, insurance, tax, or mileage-evidence purposes.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim (or a nominal amount if the Service was free). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for willful misconduct or gross negligence.
13. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, and may suspend or discontinue the Service with reasonable prior notice where practicable.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on this site before they take effect; continued use after the effective date constitutes acceptance of the updated Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising from the Service shall be subject to the exclusive jurisdiction of the competent court in Japan agreed as the operator's place of business. (Venue to be finalized upon legal review.)
